Reseña del libro "Reflections on Corporate and Trade Law (en Inglés)"
This book is a collection of research papers on various aspects of corporate and trade law. The perspective is a combination of Indian and international jurisprudence, with a focus on contemporary issues in each field. Paper One is a research paper centered on the theme of eco-labelling and consumer consciousness under International Trade Law. It looks at various cases decided under the WTO regime and how the position has evolved with time. Paper Two is an exhaustive summary of the two pillar approach to digital taxation proposed by the OECD and its impact on India. The OECD's proposal is perhaps the most ambitious one in recent times, hence the paper tries to explain the various facets of the proposed solution. Paper Three revolves around the concept of shadow libraries and whether these are conflicting with the global understanding of intellectual property rights. Shadow libraries have gained traction amongst academicians and students alike, hence it becomes important to identify whether they are inherently at odds with intellectual property rights. Paper Four explores the possibility of public-private partnerships being a remedy for the power sector in India. Paper Five traces the trajectory of e-commerce regulation under Indian anti-trust laws. Since e-commerce has only recently been of importance in India, the jurisprudence surrounding it is conflicting. Paper Six analyses the recent dispute between Amazon and Future Retail and its impact on India's anti-trust jurisprudence. The case is interesting from the point of view of anti-trust laws, as well as international arbitration methods and how these are regulated within the domestic legal framework.
